1. Acceptance of these Terms

These Terms and Conditions ("Terms") govern your access to and use of the SafeDate ID website, applications, and identity verification services (collectively, the "Service").

By accessing, purchasing, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and by our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

2. About SafeDate ID

SafeDate ID is an identity verification platform designed to help individuals reduce the risk of impersonation before meeting someone in person.

SafeDate ID is not a dating application.

SafeDate ID does not introduce users, facilitate communications between users, or arrange meetings.

The Service allows users to verify that another person has successfully completed an identity verification process performed by an independent Know Your Customer ("KYC") provider.

3. Eligibility

You may use SafeDate ID only if:

  • you are at least eighteen (18) years of age;
  • you have the legal capacity to enter into binding agreements;
  • you are not prohibited by applicable law from using identity verification services;
  • you provide accurate and truthful information.

The Service is strictly prohibited for anyone under the age of 18.

SafeDate ID may request additional information at any time to confirm eligibility.

4. Description of the Service

SafeDate ID provides an identity verification workflow that includes:

  • scanning an official government-issued identity document;
  • capturing a live selfie;
  • facial comparison between the identity document and the live selfie;
  • confirmation that the verification was successfully completed.

Identity verification is performed by our independent KYC provider, Didit.

SafeDate ID displays only the verification status necessary for both users to confirm that identity verification has been completed.

SafeDate ID does not guarantee that any individual is trustworthy, honest, safe, or free from criminal history.

5. Identity Verification Provider

Identity verification services are performed exclusively by Didit, an independent electronic identity verification provider certified under applicable European eIDAS standards.

SafeDate ID does not perform biometric verification itself.

Didit processes identity documents and biometric information solely for the purpose of identity verification.

According to Didit's retention policy, verification data is deleted after approximately thirty (30) days unless a longer retention period is required by applicable law.

SafeDate ID encourages users to review Didit's own legal documentation regarding privacy and identity verification.

6. Biometric Data

SafeDate ID does not collect, retain, sell, lease, or store biometric identifiers or biometric information.

Biometric processing is carried out exclusively by Didit during the identity verification process.

SafeDate ID receives only the verification result necessary to confirm whether the identity verification was successful.

SafeDate ID never stores:

  • facial templates;
  • biometric vectors;
  • liveness detection data;
  • raw biometric information.

7. Pricing and Payment

Each verification session costs USD $5.00 unless otherwise displayed at checkout.

Payments are securely processed by Stripe.

SafeDate ID does not collect or store payment card information.

By submitting payment, you authorize Stripe to process your transaction in accordance with its own terms and privacy policy.

Prices may change at any time without prior notice, but changes will not affect transactions already completed.

8. Refund Policy

Once the identity verification process has been initiated with Didit, the verification fee becomes non-refundable because third-party verification costs are immediately incurred.

However, you are eligible for a full refund if:

  • your invited match does not complete identity verification within fourteen (14) days after receiving your invitation; and
  • no successful mutual verification has occurred.

Refund requests may be submitted by contacting legal@safedateid.com.

SafeDate ID reserves the right to investigate refund requests to prevent abuse or fraud.

9. User Responsibilities

You agree to:

  • provide accurate information;
  • use your own identity documents;
  • complete verification honestly;
  • maintain the confidentiality of your account;
  • comply with all applicable laws;
  • use the Service only for lawful purposes.

You must immediately notify SafeDate ID if you believe your account has been compromised.

10. Prohibited Conduct

Users may not:

  • impersonate another individual;
  • upload forged or altered identity documents;
  • submit another person's selfie;
  • attempt to circumvent identity verification;
  • use automated tools or bots;
  • interfere with the Service;
  • commit fraud;
  • use stolen payment methods;
  • engage in harassment or criminal conduct;
  • exploit vulnerabilities;
  • reverse engineer the Service;
  • attempt unauthorized access to SafeDate ID systems.

Violation of this section may result in immediate termination.

11. VPN and Circumvention Prohibition

Users may not use VPNs, proxies, anonymization services, or any technical method intended to bypass geographic restrictions or prohibited jurisdictions.

SafeDate ID may suspend or permanently terminate accounts attempting to circumvent territorial restrictions.

Verification fees remain non-refundable where access restrictions are intentionally bypassed.

12. Restricted Jurisdictions

The Service is not available where biometric identity verification by private companies is prohibited or restricted by applicable law.

Without limitation, SafeDate ID currently prohibits access from:

  • Illinois (USA)
  • Russia
  • Belarus
  • Venezuela
  • Dominican Republic
  • Cuba
  • Iran
  • North Korea
  • Syria

SafeDate ID reserves the right to modify this list at any time to comply with evolving legal requirements.

Users are solely responsible for ensuring that use of the Service is lawful within their jurisdiction.

13. Limitation of Liability

SafeDate ID is designed to reduce identity fraud risk before an in-person meeting.

However, SafeDate ID does not guarantee:

  • personal safety;
  • user honesty;
  • future conduct;
  • absence of criminal history;
  • compatibility;
  • successful relationships.

Identity verification confirms only that the verified individual successfully completed the verification process using the information presented during verification.

To the fullest extent permitted by law, SafeDate ID shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from use of the Service.

Users remain solely responsible for exercising appropriate caution before meeting another person.

14. Suspension and Termination

SafeDate ID may suspend or terminate accounts immediately for violations of these Terms, fraud, abuse, illegal activity, payment disputes, or attempts to circumvent verification requirements.

Termination does not affect accrued rights or obligations.

15. Governing Law

These Terms are governed exclusively by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Nothing in these Terms limits any mandatory consumer rights available under applicable law.

For users located within the European Union, SafeDate ID endeavors to comply with applicable provisions of the General Data Protection Regulation (GDPR).

16. Dispute Resolution

Before initiating legal proceedings, users agree to first contact SafeDate ID in good faith to attempt an informal resolution.

If a dispute cannot be resolved amicably, exclusive jurisdiction shall lie with the competent courts of the Province of Quebec, Canada, except where mandatory consumer protection laws require otherwise.

17. Modifications

SafeDate ID may modify these Terms at any time.

Updated versions become effective upon publication on safedateid.com.

Continued use of the Service after modifications constitutes acceptance of the revised Terms.

19. Force Majeure

SafeDate ID shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, governmental actions, internet or telecommunications failures, cyberattacks, failures of third-party service providers, payment processors, identity verification providers, or any other event that could not reasonably have been prevented or mitigated.

During any Force Majeure event, SafeDate ID's obligations shall be suspended for the duration of the event. SafeDate ID will use commercially reasonable efforts to restore the Service as soon as practicable.

20. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions of these Terms.

21. Express Consent to Biometric Processing

Where required by applicable law, including but not limited to the laws of Colombia and Argentina, users expressly consent to the collection, processing, and temporary use of their biometric information solely for the purpose of identity verification.

By initiating the verification process, users acknowledge and expressly agree that:

  • biometric processing is performed exclusively by Didit, an independent identity verification provider;
  • SafeDate ID does not collect or store biometric identifiers or biometric templates;
  • biometric information is processed solely for identity verification and fraud prevention;
  • verification data is retained only for the period necessary to complete the verification process and in accordance with Didit's applicable retention policies and legal obligations.

Users may withdraw consent at any time prior to initiating the verification process. Once identity verification has begun, processing may continue to the extent necessary to complete the verification request and comply with applicable legal obligations.
